According to his lawyer, Artem Chigvintsev will not be commenting on his split from Nikki Garcia anytime soon, PEOPLE has learned.

Days after the 42-year-old pro on Dancing with the Stars addressed the former WWE star’s Wednesday, September 11 divorce file, Ilona Antonyan, the star’s lawyer, tells PEOPLE that “Mr. Chigvintsev will not comment on any pending proceeding at this time.”

Saying of their 4-year-old son Matteo, “the parties are focused on co-parenting and working together for the best interests of their son,” Antonyan states.

According to Antonyan, who spoke with PEOPLE, “Mr. Chigvintsev’s financial rights to support and fees are preserved by the divorce response, which is usual procedure. The right to pursue such remedies is waived if these boxes are not checked in the reply pleadings. The Request for Order, often known as the move for spousal support or costs, is not currently pending.”

In addition, the lawyer for Chigvintsev states that the “parties intend to resolve all pending issues on mutually acceptable terms.”

PEOPLE was able to access court documents that show Chigvintsev submitted his response on Friday, September 13. He asked for Matteo’s joint legal and physical custody as well as spousal support to be paid by his former wife, 40, in addition to his legal fees.

In addition, he asked the court to declare him a putative spouse for the entirety of their marriage, which is scheduled to last from August 26, 2022, until January 19, 2023.

In contrast to Garcia’s first petition, which asked for sole legal and physical custody of Matteo, Chigvintsev’s response asked for visitation rights and the court to end both parties’ eligibility for spousal maintenance.Garcia filed for divorce over two weeks after Chigvintsev was taken into custody in Napa Valley, California, on Thursday, August 29, on suspicion of beating his wife.

According to previously obtained documents by PEOPLE, he was taken into custody and lodged in the Napa County Jail. There, he was charged and granted a $25,000 bail, after which he was granted free in less than sixty minutes. Although it was never made clear, Garcia is most likely the spouse in question.

The Total Bellas actress has filed for divorce, according to a representative for her, who told PEOPLE that Garcia “continues to ask for privacy for her and her family at this time.”
